Saido Berahino will not be retrospectively punished by the Football Association following his stamp on James McCarthy on the weekend.
The West Bromwich Albion striker was involved in an off-the-ball incident with Everton midfielder McCarthy during the Baggies' 1-0 win at Goodison Park on Saturday.
Everton boss Roberto Martinez suggested Berahino should have been shown a red card for the incident but the 22-year-old has received no charge from the FA.
Referee Neil Swarbrick missed the apparent stomp on the day, prompting the incident to be passed onto a three-man panel that has since reviewed the footage.
However, they were not unanimous that the contact made by Berahino was deemed violent conduct and therefore, no further action will be taken, freeing Berahino to take his place in Albion's next match against Reading in the FA Cup fifth round on Saturday.
