New England Revolution have used their allocation pick to take returning USA international Benny Feilhaber.
The 26-year old recently signed a deal with MLS and was available to clubs via the league's allocation order for incoming US internationals.
Chivas USA and Philadelphia Union both declined their options leaving the Revs to swoop for the Brazilian-born attacking midfielder who last played in Denmark with first division club AGF Aarhus.
Feilhaber has also previously played with Hamburg in Germany and Derby County in England but will now suit up for the Eastern Conference's sixth-placed Revs.
Chivas head coach Robin Fraser admitted it was a tough decision to pass on Feilhaber but said it was purely a salary cap issue.
"This was a really difficult decision because we had to look at a number of factors, first and foremost being if we take him and accommodate his salary within our salary cap, how much is that going to limit us going forward," Fraser said.
"Certainly, we're looking to address some needs on the team, and having Benny would've been great in our midfield because he's a very, very good player. But the fact of the matter is his salary would've been so high that we wouldn't have been able to make any adjustments going forward."
